Overview of urban planning procedures
Most ground-mounted PV projects require a municipal planning procedure. Here is an overview of the process:
Decision to initiate planning
Based on a project proposal, the municipality decides to initiate a development procedure.
Preliminary design phase
Preparation of initial planning documents, commissioning of environmental reports, initial involvement
of the public and authorities
Drafting phase
Consideration of feedback, preparation of the legally binding draft,
renewed public disclosure
Statutory resolution
The municipality approves the final development plan. This is announced and then becomes legally binding.
Building law & approval
Based on the statutes, the building application can be submitted and the project approved.
Privilege under Section 35 of the German Building Code (BauGB): Fast track for PV projects
PV systems on areas within a 200-meter corridor along highways and railways can be approved directly. No urban land-use planning required. This saves time and resources.
